Recht und Unrecht. Poesie und Jura im 13. und 14. Jahrhundert

In der Geschichte Westeuropas wechselt das Verhältnis zwischen Poesie und Jurisprudenz von Phasen gegenseitiger Befruchtung bis hin zur Verschmelzung zu solchen, in denen Dichtung und Jura einander fremd werden, wenn nicht sogar sich gegenseitig ausschließen. Im 13. und 14. Jahrhundert gestaltet sich in Westeuropa das Verhältnis sehr eng; fast möchte man meinen, das eine sei ohne das andere nicht zu denken. Das Aufkommen der Vernaculare-Literatur vollzieht sich im Schlepptau des Aufstiegs von Juristen. Die eindrücklichsten Beispiele dafür finden sich in Italien und England. Die Anfänge der italienischen Literatur am Hofe von Kaiser Friedrich II. liegen in den Händen von Beamten mit juristischer Ausbildung; die Anfänge der englischen Literatur verbinden sich unter anderem mit dem umfangreichen Schaffen eines Juristen, der auch mit den Universitäten vertraut war, und Hofmanns, Geoffrey Chaucer. Das enge Verhältnis von Poesie und Jura setzt sich auch auf der Seite der Rezeption fort: Unter die ersten Leser und Förderer der jungen volkssprachlichen Literaturen fallen nachgerade Juristen. Schon im 14. Jahrhundert mehren sich, etwa in Italien, allerdings auch die Anzeichen für eine wachsende Konkurrenz und bald auch Entfremdung.

Die internationale und interdisziplinäre Tagung möchte sich dem Verhältnis von Dichtung und Jurisprudenz aus drei verschiedenen Blickwinkeln nähern:

1. Von Seiten der Person: Die Figur des Dichter-Juristen wäre neu zu befragen und an den Texten jeweils klarzumachen, ob und wie sich die juristische Ausbildung auf das Dichten auswirkt. Neben der häufig behandelten Interferenz des juristischen Kasus, der Kasuistik mit den einfachen Formen der Prosaerzählung sind besonders Beiträge zur Versdichtung erwünscht. Zudem wären die Juristen-Leser im Unterschied zu Kaufleuten oder Medizinern als Rezipienten sowie ihr Beitrag zur Literatur zu bestimmen. Von Interesse wären hier auch frühe, womöglich stereotype Darstellungen von Juristen- und Dichterfiguren in Bild und Text (Prosa oder Poesie).

2. Von Seiten der Disziplinen: Für das 13. und 14. Jahrhundert wäre zu rekonstruieren, wie das Verhältnis von Jura und Dichtung oder auch von Juristen und Dichtern dargestellt und bewertet worden ist. Wann und warum finden sich Punkte oder Phasen der Konvergenz oder Divergenz? Inwiefern kommt es in den westeuropäischen Ländern zu unterschiedlichen Entwicklungen? Und inwiefern wäre die Disziplin Jura in sich nochmals zu differenzieren? Zum Beispiel in ziviles, kanonisches Recht und Notariatsausbildung? Inwiefern beginnen Dichter und Juristen als Repräsentanten einer eigenen Disziplin miteinander darum zu streiten, wer der erste ist, wenn es darum geht, Recht und Unrecht in einer Gesellschaft zu bestimmen und damit Macht und Einfluß auf die Gesellschaftspolitik zu gewinnen?

3. Von Seiten gemeinsamer Denkweisen und Legitimitätsverfahren: In der Nachfolge Ernst Kantorowiczs, dem zufolge sich die Souveränität des schöpferischen Künstlers von Rechts-Konstruktionen im kanonischen Recht herschreibt, stellt sich die Frage nach weiteren Parallelen: beim juristischen und literarischen Umgang mit Fiktionen, beim juristischen und literarischen Verhältnis zur Natur oder auch bei Sprachbildung, Rhetorik und Begrifflichkeit.

Die Tagung, die sich gleichermaßen an Philologen, Historiker sowie an Kunst- und Rechtswissenschaftler wendet, möchte die längst bekannte Nähe von Jura und Dichtung für das Aufkommen der volkssprachlichen Literatur und die Ausbildung der Kultur im 13. und 14. Jahrhundert sowohl dia- als auch synchron neu erkunden.

Poetry and Law in the 13th and 14th century

In the history of Western Europe the relationship between poetry and law shifts between periods of mutual recognition and stimulation, and periods in which they seem to have nothing at all to share. In the course of the 13th and 14th centuries the relationship between poetry and law is very close and mutually inspiring. It is even plausible to suggest that at this time poetry cannot be thought of in the absence of law: The rise of vernacular literature is concurrent with with the rise of lawyers. The most impressive cases of this simultaneity are found in Italy and England. Italian literature emerges at the imperial court of Frederic II thanks to the poetry of civil servants who were mainly law graduates. Conversely, the beginnings of English literature are often linked to the conspicuous work of the graduate, lawyer and courtier, Geoffrey Chaucer. Similarly, the interrelated nature of poetry and law can be traced through its reception too: Lawyers are among the first readers and promoters of rising vernacular literature. However, familiarity can cause contempt and already in 14th century Italy, the signs of an increasing rivalry are starting to emerge and, what is more, signs of estrangement are visible.

This international and interdisciplinary conference intends to reflect upon the relationship between poetry and law from three perspectives:

1. From the perspective of the figure: How is the figure of the lawyer-poet represented and to what extent is there tangible impact of juridical training on vernacular writing? Beside the already explored research on the interference that runs through juridical “casus”, between the casuistics and the so-called simple narrative forms, papers on poetry are especially welcome at this conference. Furthermore, the figure of the lawyer-poet will be compared and contrasted with the literary merchant and / or medical doctor, as far as the reception of creative writing and the commitment to poetry is concerned. It would also be interesting to look for early, stereotyped representations of lawyers and poets in texts (prose or poetry) and the visual arts.

2. From the perspective of the discipline: how does the relation between poet and lawyer unfold in the 13th and 14th centuries in Western Europe? When and why do periods or moments of convergence or divergence occur? To what extent do different European countries differ from each other? How important is it to make distinctions between the branches of law, for instance between civil and canon law, or the lawyer’s and notary’s art? To what extent do poets and lawyers, who are considered as representatives of their respective disciplines, fight for ascendency in the question of who assesses justice and injustice in a society and is thereby able to play the crucial guiding role.

3. From the perspective of common ways of thinking: Following Ernst Kantorowicz, according to whom the concept of the artist’s sovereignty springs from specific fictional constructions in canonical law, it would be interesting to investigate further analogies – that is, where the juridical and literary use of fiction, the juridical and literary attitude towards nature or where language, rhetoric and other specific notions are concerned.

The conference which addresses philologists, historians as well as art- and law-historians will explore the various forms in which law and poetry relate to each other, as well as the function and significance of this relationship in the rise of vernacular literature and in the culture of the 13th and 14th centuries, in a diachronical and synchronical way.

Poesia e diritto nel Due- e Trecento

Nella storia dell’Europa occidentale, la relazione tra poesia e giurisprudenza passa da fasi di scambio proficuo che va fino all’assimilazione, a fasi di straniamento, in cui poesia e diritto sono separati e dove ogni scambio pare escluso. Nel Due- e Trecento tale relazione è molto stretta: si potrebbe quasi supporre che la poesia sia allora impensabile senza diritto. La nascita della letteratura in volgare segue di pari passo l’emergenza del diritto e dei giuristi. Esempi di tale concomitanza si trovano copiosamente in Italia ed in Inghilterra. La nascita della letteratura italiana alla corte di Federico II riposa nelle mani di funzionari con formazione giuridica; la nascita della letteratura inglese è legata, tra l’altro, all’opera ricchissima di un giurista e uomo di corte: Geoffrey Chaucer. Lo stretto legame tra poesia e diritto è pure visibile dal lato della ricezione dei testi. Tra i primi lettori e difensori della giovane letteratura in volgare si trovano molti giuristi. Tuttavia, fin dal Trecento appaiono in Italia i segni di una crescente concorrenza tra poesia e diritto che porta rapidamente alla separazione radicale tra le due discipline.

Il convegno internazionale ed interdisciplinare intende studiare la relazione tra poesia e giurisprudenza secondo tre aspetti:

1. La persona. La figura del poeta-giurista à da riconsiderare per verificare nei testi se e come la formazione giuridica influenza il lavoro del poeta. Oltre lo studio, in parte già svolto, delle interferenze dei casi giuridici e della casuistica con le forme semplici del racconto in prosa, saranno ben accette le comunicazioni sulla poesia. Bisognerebbe poi considerare il ruolo di destinatario svolto dai giuristi-lettori, e confrontarlo con altre forme di lettorato, quali i mercanti e i medici, così come il loro contributo alla letteratura. Sarebbe interessante infine analizzare, quando possibile, le prime rappresentazioni stereotipate di giuristi-poeti, nelle immagini e nei testi (in prosa o in poesia).

2. Le discipline. Per il Due- e Trecento bisognerebbe ricostruire come la relazione tra diritto e poesia o tra giuristi e poeti fu rappresentata e valutata. Quando e perché si trovano punti o fasi di convergenza o di divergenza? In che misura tale relazione evolve diversamente nei diversi stati europei? In che modo il diritto, in quanto disciplina, continua a differenziarsi – per esempio in diritto civile, canonico e notariale? In che misura poeti e giuristi, in qualità di rappresentanti delle loro discipline, cominciano a discutere per definire chi tra loro sia il primo in grado di decidere cosa è giusto o ingiusto nella società, e così acquisire potere ed influenzare la politica e la società?

3. Le mentalità ed il processo di legittimazione. Seguendo Ernst Kantorowicz, secondo cui la sovranità dell’artista creatore s’ispira alle costruzioni fittizie nel diritto canonico, si può pensare a nuovi parallelismi, che riguardano l’uso letterario e giuridico della finzione, così come il rapporto rispettivo alla natura o ancora la formazione linguistica e le sue implicazioni retoriche e concettuali.

Il convegno è destinato a filologi, storici, ma anche storici dell’arte e giuristi e intende esplorare la nota vicinanza tra diritto e poesia per contribuire allo studio dell’avvento della letteratura in volgare e della formazione della cultura nel Due- e Trecento, sia in sincronia che in diacronia.

Poésie et droit aux XIIIe et XIVe siècles.

Dans l’histoire de l’Europe occidentale, la relation entre poésie et jurisprudence évolue d’une phase de réciprocité bénéfique et ensuite d’assimilation, jusqu’à une séparation radicale entre poésie et droit, où toute forme de réciprocité est exclue. En effet, aux XIIIe et XIVe siècles, les liens entre poésie et droit en Europe occidentale sont très étroits, au point que l’une paraît impensable sans l’autre. Les premiers textes poétiques en langue vernaculaire apparaissent à la suite de l’essor du droit et des juristes. On trouve à ce sujet une liste importante d’exemples en Italie et en Angleterre. L’essor de la poésie italienne à la cour de l’empereur Frédéric II est dû à l’action de fonctionnaires ayant une formation juridique ; les débuts de la littérature anglaise sont liés, entre autres, à l’œuvre foisonnante d’un étudiant en droit et homme de cour : Geoffrey Chaucer. La relation étroite entre poésie et droit est aussi présente du côté de la réception. Parmi les lecteurs et promoteurs des premières œuvres en langue vernaculaire se trouvent massivement des juristes. Toutefois dès le XIVe siècle, en Italie, paraissent les signes d’une concurrence accrue et bientôt d’un éloignement progressif entre droit et poésie.

Le colloque international et interdisciplinaire souhaite appréhender la relation entre poésie et jurisprudence sous trois différents aspects :

1. du côté de la personne. Il faudrait interroger la figure du poète-juriste et éclaircir dans les textes si et comment la formation juridique affecte le travail du poète. Outre l’étude des interférences des cas juridiques et de la casuistique avec les formes simples du récit en prose (qui ont déjà fait l’objet d’analyses), il serait important de considérer leur influence sur les formes poétiques. De plus, il faudrait définir le statut de destinataire des juristes-lecteurs par rapport à celui des marchands et des médecins, ainsi que leur contribution à la littérature. Il serait aussi intéressant d’étudier, si le cas se présente, les premières représentations stéréotypées de juristes-poètes dans l’art et dans les textes (prose ou vers).

2. Du côté des disciplines : pour les XIIIe et XIVe siècles il faudrait reconstituer comment était représentée et évaluée la relation entre droit et poésie ou aussi entre juristes et poètes. Quand et pourquoi se trouvent des points ou des phases de convergence ou de divergence entre les deux ? Dans quelle mesure cette relation évolue différemment dans les pays de l’Europe occidentale ? Comment la discipline du droit en vient encore à se structurer et à se hiérarchiser en son intérieur – par exemple entre droit civil, canonique et formation notariale ? Dans quelle mesure poètes et juristes, en tant que représentants de leur propre discipline, discutent pour savoir qui des deux est le premier à devoir décider, quand le cas se présente, ce qui est juste ou injuste dans une société, et ainsi acquérir du pouvoir et de l’influence sur la vie politique et sur la société ?

3. Du côté des mentalités et du processus de légitimation : A la suite de Ernst Kantorowicz, d’après qui la souveraineté de l’artiste créateur s’inspire aux fictions juridique en droit canonique, nous pouvons interroger d’autres parallélismes possibles, en ce qui concerne la facon de traiter les fictions dans le champ juridiques ou littéraires , ou la facon de penser la nature ou bien l’usage de la rhétorique e des notions conceptuelles.

Le colloque s’adresse à la fois à des philologues, des historiens, ainsi qu’à des historiens de l’art et à des juristes, pour explorer à nouveaux frais la bien connue proximité entre droit et poésie et chercher ainsi à mieux comprendre l’essor de la littérature en langue vernaculaire et la formation de la culture du XIVe siècle, dans une perspective à la fois diachronique et synchronique.

Poesía y Derecho en los Siglos XIII y XIV

En la historia de Europa Occidental, la relación entre poesía y derecho ha oscilado entre fases de un fructífero intercambio o incluso una identificación total hasta otras marcadas por un claro distanciamiento y aun una exclusión mutua. En los siglos XIII y XIV dicha relación es muy estrecha: es posible incluso suponer que la poesía fuera, en esa fase, impensable sin el derecho. El nacimiento de la literatura en lenguas romance es un proceso paralelo al ascenso de los juristas, encontrándose los mejores ejemplos en Italia e Inglaterra. Los comienzos de la literatura italiana en la corte del Emperador Federico II. se encuentran en manos de funcionarios con formación jurídica, mientras los comienzos de la literatura inglesa convergen, entre otros, en la prolífera obra de un jurista cortesano y académico: Geoffrey Chaucer. La relación estrecha entre poesía y derecho se hace también visible en el ámbito de la recepción de los textos. Entre los primeros lectores y defensores de la joven literatura vernacular se encuentran muchos juristas. Sin embargo, ya en el siglo XIV emergen en Italia los primeros signos de una creciente competencia entre poesía y derecho que conllevará rápidamente a la separación radical de ambas disciplinas.

Este congreso internacional e interdisciplinario tiene como fin estudiar la relación entre poesía y derecho haciendo énfasis en tres aspectos:

1. La persona. La figura del poeta-jurista debe ser reconsiderada para verificar textualmente si la formación jurídica influyó (y de qué manera) en el trabajo del poeta. Además de la ya tematizada interferencia entre la casuística y las formas simples de narraciones en prosa se desean especialmente ponencias relativas a la poesía. Sería también pertinente considerar el rol del destinatario en tanto lector jurista y confrontarlo con otras formas de lectores, tales como los médicos y comerciantes, así como su contribución a la literatura. A su vez, es un fin del congreso el analizar, en lo que sea posible, las primeras representaciones estereotípicas de juristas poetas en las imágenes y los textos (en prosa o poesía).

2. Las disciplinas. Para los siglos XIII y XIV sería conveniente reconstruir cómo la relación entre derecho y poesía o entre juristas y poetas fue representada y valorizada. Cómo y por qué se encuentran puntos o fases de convergencia o divergencia? En qué medida dicha relación se desenvuelve de manera diversa en los países europeos? En qué modo el derecho, en cuanto disciplina, continúa a ramificarse -por ejemplo en derecho civil, canónico y notarial? En qué medida los poetas y juristas, en calidad de representantes de sus respectivas disciplinas, comienzan a discutir para definir quién de ellos es el llamado a definir qué es lo justo y lo injusto en una sociedad, para así adquirir poder e influencia sobre la política social?

3. Las mentalidades y los procesos de legitimación. Siguiendo a Ernst Kantorowicz, según el cual la soberanía del artista creador se inspira en las construcciones jurídicas del derecho canónico, es preciso repensar nuevos paralelismos referentes al uso literario y jurídico de la ficción, así como la relación jurídica y literaria para con la naturaleza, con la creación del lenguaje y sus implicaciones retóricas y conceptuales.
El congreso está dirigido a filólogos, historiadores, historiadores del arte y juristas y busca explorar la ya conocida y notoria cercanía entre derecho y poesía para contribuir así al estudio del desarrollo de la literatura en lenguas romance y de la formación de la cultura en los siglos XIII y XIV tanto de manera diacrónica como sincrónica.

Los resúmenes de las propuestas puede ser redactados en cualquier lengua europea.
El congreso tendrá lugar en Gottinga, en otoño de 2016.
